These Terms govern your use of insuredwithamit.com and any related services offered by Amit Sharda, an Ontario-licensed insurance broker. They are written to align with the Registered Insurance Brokers Act, the RIBO Code of Conduct, and applicable consumer-protection law. Read them carefully — by using the site or asking us for an insurance quote, you agree to them.

01Agreement to terms

By accessing this website, requesting a quote, or otherwise communicating with us, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the site. We may revise these Terms from time to time; the version posted at the time you use the site governs.

04When a broker–client relationship begins

Browsing this website does not create a broker–client relationship. We act as your broker only after you have provided the information we need to identify a risk, we have agreed (verbally, in writing, or by exchange of email) to seek coverage on your behalf, and you have signed any required broker authorization or applications.

Until coverage is bound in writing by an insurer, no insurance is in force regardless of any quote, indication, application, or down-payment.

05Our regulatory duties to you

As a RIBO-licensed broker, we owe you the duties set out in the RIBO Code of Conduct, including the duty to act with honesty and fairness, to provide competent service, to recommend coverage that reasonably meets your disclosed needs, to disclose material conflicts of interest, and to handle confidential information appropriately.

06Disclosures & conflicts of interest

We are an independent broker. We are paid primarily by commissions from the insurer with which your policy is placed. From time to time we may receive contingent or profit-sharing compensation based on a portfolio's overall results, finance or service fees disclosed in advance, or non-monetary benefits such as training. A list of carriers we represent and an explanation of our compensation structure is available on request and is also described in the Brokerage's master Consumer Disclosure document, which we encourage you to read. If a material conflict of interest exists in respect of your file, we will disclose it to you in writing and obtain your informed consent before continuing.

07Your duties as an applicant or insured

  • Disclosure. You must answer all underwriting questions fully and accurately and disclose any fact that would influence a reasonable insurer's decision to insure or to set a premium.
  • Material change. You must promptly notify us of any material change during the term of the policy — for example, an additional driver, a vacancy at an insured property, a change of use, a renovation, or a new business activity.
  • Premium. You must pay premiums when due. Late or returned payments may result in registration cancellation, policy cancellation, or non-renewal.
  • Read your policy. When you receive policy documents, read them and tell us promptly if anything is inaccurate or unclear.

Failure to disclose, misrepresentation, or material change without notice can void coverage from inception under the Insurance Act (Ontario) and your insurer's policy wording.

08Quotes, premiums & binding

Quotes are non-binding indications based on the information you provide and are subject to underwriting, inspection, satisfactory loss history and verification. Premiums, taxes, broker fees and surcharges are determined by the insurer and may change between quote and bind. Any broker service fees we charge will be disclosed to you in writing before the fee is incurred.

09Claims

Coverage decisions, claim adjudication and payment are made by the insurer, not by us. We will assist you in reporting a claim, communicating with adjusters, understanding your policy wording, and advocating for fair treatment, but we cannot guarantee any particular claim outcome. Time limits to report claims and to commence legal action are set by your policy and the Limitations Act, 2002. Report claims to us or directly to your insurer as soon as reasonably possible.

10Use of the website

You agree to use the site only for lawful purposes. You will not:

  • interfere with the site's operation, security or availability;
  • attempt to access accounts, data or systems you are not authorized to access;
  • scrape, harvest or copy material in volume except as expressly permitted;
  • impersonate any person or submit false information;
  • use the site to transmit malware, spam, or unlawful, defamatory or infringing material.

11Intellectual property

All content on insuredwithamit.com — text, graphics, photography, logos, layout and code — is owned by Amit Sharda or used under licence and is protected by Canadian and international copyright and trademark law. You may view and print individual pages for personal, non-commercial use. All other use, reproduction or distribution requires our prior written consent.

12Third-party links & tools

The site may link to insurer portals, payment processors, social-media platforms or other third-party resources. We do not control those resources and are not responsible for their content, terms, or privacy practices. Your use of a third-party site is at your own risk and is governed by that site's terms.

13Testimonials & reviews

Client testimonials and reviews shown on the site reflect individual experiences and are not a guarantee of any particular outcome. Where required, testimonials are used with consent and may be edited for length or clarity without changing meaning.

14No warranties

Except for any obligations imposed by law that cannot be excluded, the website and its content are provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy or uninterrupted operation.

15Limitation of liability

Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law, including the duty of an insurance broker to its client, liability for fraud, fraudulent misrepresentation, or for personal injury or death caused by negligence.

Subject to the foregoing, to the maximum extent permitted by law, Amit Sharda and the Brokerage will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profit, revenue, goodwill, or data, arising out of or in connection with your use of this website. Our total aggregate liability for any claim arising from your use of the website (excluding our duties as your broker once a broker–client relationship has been established) is limited to CA$100.

What this clause does not do

It does not cap liability for our professional services as your broker, which are covered by the Brokerage's errors-and-omissions (E&O) insurance maintained as required by RIBO. Claims arising from professional services follow the law and the terms of that policy.

16Indemnity

You agree to indemnify and hold us harmless from any claim, loss, demand, or expense (including reasonable legal fees) arising out of (a) information you submit that is false, misleading or infringes another person's rights, (b) your breach of these Terms, or (c) your unlawful use of the website.

17Suspension & termination

We may suspend or terminate access to the site at any time, without notice, if we reasonably believe these Terms have been breached or that continued access creates a legal or security risk. Sections that by their nature should survive termination (including Sections 11, 14, 15, 16, 18, 19 and 20) will do so.

18Complaints & dispute resolution

We take complaints seriously and aim to resolve them quickly and fairly. The Brokerage maintains a written complaints-handling protocol consistent with RIBO's expectations.

  1. Speak with Amit. Most issues are resolved through a direct conversation.
  2. Escalate to the Brokerage. If unresolved, submit a written complaint to the Billyard Insurance Group Ltd. Complaints Officer at the address in Section 2. We will acknowledge in writing and respond as soon as reasonably possible. [CONFIRM Brokerage complaints contact and response timelines.]
  3. Regulator. Concerns about a broker's professional conduct may be raised with the Registered Insurance Brokers of Ontario (RIBO).
  4. OmbudService. For unresolved disputes about general (auto, home, business) insurance products, you may contact the General Insurance OmbudService (GIO). For life and health products, the OmbudService for Life & Health Insurance (OLHI).
  5. Provincial regulator. The Financial Services Regulatory Authority of Ontario (FSRA) oversees insurance conduct in Ontario.

19Governing law & jurisdiction

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-laws principles. The courts of Ontario have exclusive jurisdiction over any dispute, subject to your statutory rights as a consumer that cannot be waived by contract.

20General

  • Entire agreement. These Terms, the Privacy Policy, the Accessibility statement and any signed engagement constitute the entire agreement between us regarding the website. They do not replace policy wordings issued by an insurer.
  • Severability. If any provision is held unenforceable, the remainder continues in effect.
  • No waiver. A failure to enforce any provision is not a waiver of the right to do so later.
  • Assignment. You may not assign your rights or obligations without our consent. We may assign in connection with a sale or reorganization of the Brokerage.
  • Language. The parties have requested that these Terms and all related documents be drawn up in English. Les parties ont exigé que la présente convention et tous les documents s'y rattachant soient rédigés en anglais.
